Fees
Per diem fee: $2,000
Docketing fee: None
The per diem fee applies to each day charged for hearing, research, study, drafting, and case administration. Ordinary office expenses, including routine printing, copying, postage, telephone, and electronic communications, are included in the professional fee.
Travel
Travel expenses are billed from the least expensive FMCS-listed location to the hearing site, consistent with 29 C.F.R. § 1404.15(b). Travel-time charges are calculated from the same location.
Listed locations: Coeur d’Alene, Idaho; Minneapolis, Minnesota; Columbus, Ohio; and Las Vegas, Nevada.
Travel time is billed at $250 per hour, up to a maximum of $2,000 per travel day.
Necessary airfare, lodging, parking, tolls, and ground transportation are billed at actual cost, subject to the billing-location limitation above. Mileage for travel by personal vehicle is billed at the IRS business mileage rate in effect at the time of travel. Meals are not billed separately.
Cancellation and Postponement
A cancellation or postponement fee of $2,000 per reserved hearing day will be assessed if notice is received within 14 calendar days before the first scheduled hearing date. For a multi-day hearing, the fee applies to each reserved hearing day canceled or postponed.
The parties are also responsible for all non-recoverable expenses associated with the canceled or postponed hearing, including nonrefundable travel reservations.
Allocation of Fees and Expenses
Fees and expenses are shared equally by the parties unless they agree otherwise.
